Family Court or a Criminal Court?

If you are eligible to go to Family Court you may also go to a criminal court.

You may have a case in both these courts and a divorce or separation case in Supreme Court. Any of these courts has the power to issue an order of protection.

To get an order of protection in a criminal court there must be criminal charges against the person who is abusing you.

To get an order of protection in Family Court it does not matter if the abuse was a crime. If it was a crime you may still go to Family Court.
